The case against Panamarou is dismissed

30/06/10

The Niasvizh District Court decided that the activist of the Movement for Freedom (MFF) didn’t insult the official.

The final session on the administrative case against the MFF Kletsk activist Siarhiey Panamarou was held on June 29 in Niasvizh town. (The decision of the Kletsk Town Court didn’t satisfy the activist, and he appealed against it.) Panamarou was accused of insulting the head of the Kletsk Housing and Utility Service (HUS) Mr. Navitski.

The official filed the appeal against the activist to the militia after Panamarou complained on him. (In fact, it was Panamarou who was insulted by the Kletsk official).

The court has virtually admitted that the counter-claim of the official was framed up. The witnesses on the part of the Kletsk HUS head floundered in their testimony. Their evidence contradicted Navitski’s words, and the precinct militia officer Mr. Haradziey couldn’t explain why the protocol drawn up against Panamarou didn’t contain the activist’s signature. The court considered Panamarou’s opinion to be reasonable – Panamarou thinks this protocol was deliberately framed up by the militia and by the HUS head in order to divert the punishment of the official. Moreover, the witnesses of the talk between the MFF activist and the HUS head Mr. Savielyeu and Mr. Dziatko stated that it was from Mr. Navitski that they heard the insults to the Panamarou’s address.

Judge Maryna Dunayeva decided to dismiss the administrative case in relation to Panamarou due to the absence of the proof of guilt.

Panamarou – who insisted that his case be considered not in the Kletsk District Court but in the Niasvizh District Court – is completely satisfied with such decision. He intends to prepare the appeals to the Prosecutor’s Office and to the Internal Affairs Office of the Minsk Region Executive Committee in order to ensure the punishment not only of Mr. Navitski for the insult, but also of his accomplices for slander and perjury.
