Court unwilling to consider the complaint about the conditions of detention in isolation ward
According to the Judicial Bench of the Brest Region Court, the regulation of the conditions of detention of the persons suspected of offences doesn’t belong to the courts’ jurisdiction, but is in the competence of the Ministry of Internal Affairs.
The activist of the Movement for Freedom (MFF) Ivan Stasiuk – who was detained on February 3, 2010, and remained in the temporary detention isolation ward for three days – sent the complaint about the bad conditions of detention in the Brest investigatory isolation ward to the Brest District Court and, afterwards, to the judicial bench of the Brest Region Court. However, the courts refused to initiate a civil case.
The activist thinks that the bad conditions of detention in the temporary detention isolation ward, as well as the denial of a fair trial violate Articles 7 and 10 of The International Covenant On Civil and Political Rights.
“We will appeal to various entities of the Ministry of Internal Affairs demanding to ensure the acceptable conditions of detention for citizens sent to the Brest isolation ward. A complaint has already been prepared, and will be sent to the Internal Affairs Office of the Brest Region Executive Committee”, the MFF activist Raman Kislak informed.
