Astraviets Court dismisses the case against Ivan Kruk

The Movement for Freedom (MFF) activist managed to persuade the judge that the administrative case initiated against him for the distribution of newspapers with no publisher's imprint doesn’t correspond to the code of practice.

 

Ivan Kruk stated (his reasoning amounted to five pages) that The Legal Assistance for Population newsletter – for the distribution of which the protocol was drawn up against the activist on May 16 under part 2 of Article 22.9 of the Administrative Code – had, in fact, the required printer’s imprint, and was distributed in accordance with the Law, while the breach of law protocol, according to Kruk, was drawn up based on the request of the interested representatives of the Astraviets District Executive Committee which contradicts Article 16.4 of the Practice and Executive Administrative Code.

 

The activist asked the Astraviets District Court to hold the administrative protocol No.100537 non-corresponding to the requirements of Articles 6.14 and 10.1 of the Practice and Executive Administrative Code of the Republic of Belarus, and to dismiss the administrative case initiated against him based on the absence of the breach of law.

 

On June 17, the judge of the Astraviets District Mr. Yankouski made the decision to dismiss the administrative case under Article 22.9 of the Administrative Offences Code in relation to Kruk due to the absence of the elements essential to the offence, and due to the expiration of the term of administrative punishment.

 

“I’m totally satisfied with such outcome. Law and justice were completely restored at this session of the Astraviets District Court”, Kruk comments on the court decision.
